Issues: access, child support for a minor; child support for adult child attending university away from home
We successfully represented a father whose wife brought a petition for divorce nearly 10 years after they had separated. She also claimed child support for a 13 year old who she had not allowed the father to see in 10 years. In addition, she claimed child support for an adult child who was living away from home in university and did not want to have anything to do with her father. We successfully argued that the father, who was a salesperson with a fluctuating income, should pay child support to the 13 year old based on the average of his income from the last few years and as long as he had access to his son. With respect to the adult child, the judge agreed with us that the father did not have to pay any child support at all but only a portion of her university expenses as long as she provided him with her marks and maintained contact with him. The bottom line here was that a person shouldnt have to pay child support and get nothing in return at all.
Issues: custody of four year old changing from mother to father
Our client, the father of a four year old, brought a motion for custody. Our client was awarded custody despite the fact that there was a previous order for custody in favour of the mother. We relied on the fact that the mother disregarded access orders and frequently acted in bad faith in bringing court motions to prove to the court it was not in the childs best interest to remain with his mother. Our client was not only granted custody but child support also.
Issue: Grandparents custody of 1 year old
We represented the maternal grandparents of a 1 year old girl whose parents were suffering from drug addictions. The paternal grandparents also sought certain rights to the girl but our clients were awarded final custody of her.
Issue: cost award of $35,000.00
Our 67 year old client suffered from long delays, unreasonable positions and enduring her husbands failure to provide adequate disclosure. As a result, we were successful in having a cost award of $35,000.00 awarded against him to cover our clients legal fees.
