Fraud charge for $500?

Postby 82maners » Fri Feb 03, 2012 7:18 pm

Part of my separation agreement was to maintain my now ex wife's health coverage costs, which I faithfully did for five years. A couple of years ago she was in a motor vehicle accident and submitted claims for massage, speech therapy, and medication. The insurance company cheques were sent to me and I always sent the money through to her. When it came to finally getting my divorce she was difficult to say the least and it cost me another few thousand to finalise everything.

So just before the divorce became final I received a $500 cheque, which due to all the aggravation I decided to keep. A month ago I received a letter from her lawyer who is also handling the car accident, requesting me to send her the $500, I decided not to.

Now today I get a call from a Police Detective (really) saying fraud charges might be laid against me for this $500. Can this possibly be true??? I paid over $250K to this woman, can this really be happening? :o

Although this issue is in releation to a term contained in your Separation Agreement, fraud charges are a criminal law matter and beyond the scope of our advice as family law lawyers. I would suggest you contact a criminal law lawyer to deal with this matter immediately.

Well I bet most everyone who read this found it hard to believe. I've heard stories of husbands not paying as per their separation agreement for years, for monies that go into the tens of thousands. I talked to my lawyer and he said "it's possible", so for $500 why fight, I've already lost a lot more.

Still I bet it makes a lot of the guys here wish they never married this girl!
