8) Can I deduct my legal fees on my Income Tax Return?

If you are a recipient of child or spousal support, you may be eligible to deduct a portion of your legal fees, if they were paid to:

  1. obtain an order or agreement for support
  2. enforce an existing order or agreement for support
  3. vary an existing order or agreement for support
  4. defend a support reduction

Legal fees incurred by a support payor are not deductible.
